These Terms of Use ("Terms") are an agreement between you and New Vision Training, Inc., doing business as SW Service Solutions, governing your access to Fixed Ops University OS ("FOU OS"). By creating an account, accepting an invitation, purchasing access, or using FOU OS, you agree to these Terms and our Privacy Policy.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter into these Terms. If you use FOU OS through an employer or organization, you represent that you are authorized to use the account and understand that authorized organization administrators may manage access and view permitted training information.
2. Accounts
Provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. Accounts are personal and may not be shared unless we expressly authorize a managed organization account. You are responsible for activity conducted through your credentials.
3. License and ownership
Subject to these Terms and payment of applicable fees, we grant you a limited, personal, nonexclusive, nontransferable, revocable right to access FOU OS for professional training. FOU OS, Ask Sally, course materials, videos, scripts, word tracks, graphics, trademarks, software, and related content are owned by or licensed to SW Service Solutions and are protected by law.
You may use course materials for your own authorized training and workplace application. You may not copy, publish, sell, sublicense, scrape, systematically download, reverse engineer, train an AI system on, or commercially distribute our materials without written permission.
4. Acceptable use
- Do not violate law, intellectual-property rights, privacy rights, workplace policies, or safety requirements.
- Do not upload malware, attempt unauthorized access, evade limits, interfere with service operation, or misuse another person's account.
- Do not submit payment-card data, customer financial data, government identifiers, protected health information, or unnecessary confidential customer information to Ask Sally.
- Do not use FOU OS to harass, discriminate, threaten, deceive, or make employment decisions unlawfully.
- Do not rely on Ask Sally for manufacturer specifications, recalls, legal conclusions, HR decisions, or safety-critical procedures without verifying an authoritative source.
5. Training and AI limitations
FOU OS provides educational and coaching content, not legal, accounting, employment, medical, engineering, warranty, manufacturer, or safety advice. Ask Sally uses AI and may produce incomplete, outdated, or incorrect information. Always consult official manufacturer information, current laws and regulations, your employer's policies, and qualified professionals when appropriate.
6. Organization accounts
Organizations may assign seats, academies, courses, and managerial permissions. The organization may suspend or end a user's access when employment, membership, or the organization's subscription changes. Organization administrators are responsible for lawful user invitations, role assignments, and use of workforce training information.
7. Fees, subscriptions, and access
Prices, included features, seat limits, Ask Sally allowances, billing intervals, and access periods are shown at purchase or in an applicable agreement. Taxes may apply. Digital access begins when an entitlement is activated. Organization contracts may include additional controlling terms.
The first mobile-app release is intended for login and access by existing members. Consumer purchases are completed through our authorized website unless and until native app-store purchasing is offered.
8. Cancellation and refunds
Monthly subscriptions may be canceled before the next renewal date. Cancellation prevents future renewal, and access continues through the end of the current paid billing period. Amounts already paid are nonrefundable except where required by law. Purchases become nonrefundable after training access begins, except where required by law. Additional details appear in our Cancellation and Refund Policy or an applicable written agreement.
9. Availability and changes
We may update, improve, suspend, replace, or discontinue features, courses, AI providers, integrations, or content. We do not guarantee uninterrupted availability, completion outcomes, career advancement, compensation, sales performance, certification recognition, or business results.
10. Suspension and termination
We may restrict or terminate access for nonpayment, security risk, unlawful conduct, abuse, material breach, or misuse of intellectual property. You may stop using FOU OS and request account deletion, subject to these Terms and applicable retention obligations.
11. Third-party services
FOU OS uses third-party platforms for hosting, authentication, AI, voice, payments, video, email, webinars, and related functions. Their services may be governed by separate terms. We are not responsible for third-party services outside our reasonable control.
12. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOU OS AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW VISION TRAINING, INC., SW SERVICE SOLUTIONS, AND THEIR OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM FOU OS. Our aggregate liability will not exceed the amount you paid for the affected service during the twelve months before the event giving rise to the claim. Applicable law may provide rights that cannot be limited.
14. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction serving Okaloosa County, Florida, unless applicable law requires otherwise.
15. Changes and contact
